Why Didn’t Bicyclist Stop after Hitting Car? | Part 1

in a parking lot. >> Judge Judy: Mr. Helke, you claim that the defendant hit your car with his bike. >> Yes. >> Judge Judy: When did this happen? >> August 7th. >> Judge Judy: Would you go over to the chart and show me what you were doing? >> I was going down south on 58, and I was going to pull in this 15-minute parking — it’s in front of a post office — to mail some bills. There was a Jeep in this parking lot with the backup lights on.

I was trying to keep an eye on that. So I just pulled up here, started pulling over, and I felt something hit the car. I looked behind, I thought maybe that Jeep got me, but I was way past the Jeep, and then I saw him on the side of the car. And him and my girlfriend — He was hollering, he didn’t the car. >> Judge Judy: But he hit your car from the rear? >> He hit a back door on the passenger side. >> Judge Judy: Okay. Do you have photographs of the damage? >> Yes. >> Judge Judy: May I see it, please? And where were you going, Mr. Fitzgerald? >> I was going home. >> Judge Judy: Now, when your bicycle and Mr. Helke’s car came in contact with each other, did you stop? >> Uh, I did — >> Judge Judy: “Uh” is — Did you stop? That’s either a yes or a no.

>> Yes. >> Judge Judy: Did you get off your bike? >> Sort of. >> Judge Judy: What does that mean? >> Not really. You know, one foot off. >> Judge Judy: And then what did you do? >> Well, he was, you know, screaming at me. I was genuinely scared for my life. So I biked away. You know, I thought he might be drunk driving or something. >> Judge Judy: So you left. >> Right. >> Judge Judy: Well, that wasn’t the right thing to do, sir. >> Well, I mean — >> Judge Judy: You have a phone with you.

Everybody has a phone with them. So that if you felt threatened at all, you call 911 from your phone, and you say, “I was just involved in an accident, and could somebody send a police officer here?” >> Right, I mean, you had to be there, though. In the heat of the moment — >> Judge Judy: No, I don’t have to be there. No, I don’t have to be there. I say that’s what somebody who felt as if they were wronged — because you say, “He hit me.” That’s what you say.

And that he threatened you, and stole your lunch when he came to your house. All kinds of ridiculousness. Except stopping the car when your bike and his car come in contact. Notice, I didn’t say, “You hit his car,” because I haven’t made that judgment yet, but that’s what you do. You stop. Now, you didn’t. Where did you go? >> Home. >> Judge Judy: Directly? >> Yes. >> Judge Judy: So you went directly home? Didn’t go to a parking lot, didn’t get anywhere else? >> Again, I thought he was trying to run me over with his car. >> Judge Judy: [ Raps desk ] That’s not what I asked you. I said, “Didn’t stop anywhere?” >> No. >> Judge Judy: And when you got to your house, I assume you ran into your house.

>> Right, and locked the door. [ Laughter ] >> Judge Judy: Did you call the police? >> I did after he tried to break into my house. >> Judge Judy: Just a second. When you got into your house and locked the door… >> Right. >> Judge Judy: …why didn’t you call the police as soon as you locked the door? >> I did. >> Judge Judy: No, you didn’t. >> I got in my house, and I called the police. >> Judge Judy: No, no, no, no, no. That’s not what you said to me. You said you called the police after he tried to get into your house. >> Right. >> Judge Judy: Which means he had to pull up in your house, get out of the car. He doesn’t move quickly unless he’s somehow going downhill from the time of this incident in August.

So it took him some time to get out of his car and into your house. You said you didn’t call the police until after he tried to get into your house. So what I’m asking you is, if you had been involved in an accident that wasn’t your fault, why didn’t you call the police immediately if he hit you?
